The account for depositing/increasing registered capital is intended to tie the registered capital of a company depositing/increasing its capital at least until such time as a decision is delivered from the registration court. An extract from this account is one of the documents for recording the level of a company’s registered capital in the Commercial Register.
Under the law a business company may not dispose with the financial resources deposited in an account in order to increase registered capital, with the exception of the payment of fees and expenses related to the increase itself.
After the delivery of a decision by the registration court (extract from the Commercial Register in which the increased registered capital is already recorded) the account for an increase of registered capital is transformed, if the owner so desires, into a standard current account or product package and the accountholder may now dispose freely of the resources deposited and with the account. If the increase of a company’s registered capital is not recorded in the Commercial Register, the bank leaves the deposits in this account until such time as the holder informs it as to what to do with them. The accountholder is obliged to corroborate this fact to the bank by submitting the decision of the registration court.
